This appeal is in reference to the response of my RTI query (DOHED/R/2017/53284)[dott] My query was as follows: Please provide me true photocopies of all written communications including hard copy documents and email communications, between Prof Rajeev Kumar (ex-Professor, Dept CSE, IIT Kharagpur and currently Professor of JNU) and Shri R Subrahmanyam (Additional Secretary (TE), MHRD) at his two official email ids (R[dott]subra[at]nic[dott]in, subrahyd[at]gmail[dott]com), since June 2014 till date[dott], where Shri R Subrahmanyam or Prof Rajeev Kumar is the sender or one of the recipients of the said communication[dott] No information has been provided to me citing the following reasons: requested information is a third party information and has no co-relation with public activity[dott] There has been information exchange between Additional Secretary and Rajeev Kumar on his official email id regarding matters relating to IIT Kharagpur and involving various issues related to IIT Kharagpur[dott] Such information need to be made available through RTI because of following reasons[dott] (A) Any information exchanged made through hard copy must be available with MHRD (B) Information exchanged through nic[dott]in email-id should be provided through RTI as (a) this facility is provided by GoI for making official communication not for personal use, (b) MHRD must have access to all emails as nic[dott]in is maintained by GoI[dott] (C) Information exchanged through gmail id should also be provided through RTI in this case as (a) the email id is listed in official website of MHRD, (b) denying of information by citing third party will help the Govt officials to hide important information exchanged with the others by using such email ids[dott] Information exchanged through the officially listed email ids cannot be third party information[dott] Moreover, information exchanged by Govt officials like Additional Secretary can have implications with public activity and cannot be third party information[dott] Therefore, kindly provide me the requested information at the earliest[dott] If it is denied, we will push both through RTI and legally for him to make them public or to be reviewed by MHRD[dott]
