This first appeal, under section 19(1) of RTI Act, 2005 I submitted against deemed refusal of the information, sought in RTI application dated 20.07.2015. The CPIOs order dated Oct. 01, 2015 is inappropriate due to the following: I. The CPIOs order stating, ... President Secretariat I.D. No. 29(4)(i)/2012-CA (II) dated 28.02.2013 has not been received by the office of the undersigned and also not found as per available records in the TS-I Section dealing with subject ..., is incorrect as a copy of this letter was disclosed under RTI Act by the same TS-I section. A copy of this letter is enclosed. It could be observed by the notings on this letter that this letter was received on March 04, 2013 in the Ministry, HRD the initials and notings by the concerned officials, namely Additional Secretary (Technical Edu.), Director, Under Secretary are also on this letter. II. The CPIOs order stating, The file on which copy of the letter dated 03.09.2014 forwarded vide President Secretariat ID No. 29001/2/2014-CA (III) dated 22.09.2014 has been dealt with is presently as on date under submission and the file note sheets will be provided on payment of the requisite amount as photo copy charges which will be intimated in due course on receipt of the file, is inappropriate. Since receiving the CPIOs order, I have been repeatedly requesting the CPIO and the concerned officials of the TS-I section, I am not told the amount of photo copying as the file remained under submission so far. The above is deemed refusal of information as it is incumbent upon the CPIO to requisition the file, which is within the Min. HRD either in the same section or with other officials of the Ministry. 2.In view of the above, I submit this FIRST APPEAL under Section 19(1) of RTI Act 2005, and request the First Appellate Authority to kindly direct the concerned CPIO for (i) allowing this applicant/appellant for inspection of all the concerned files, and then (ii) supply of one photo-copy each of all the relevant file note-sheets/documents as sought in my RTI application, dated Sep. 09, 2015, free of charge in accordance with Section 7(6) of RTI Act, 2005.
