I have uploaded a 6-page pdf document of which first five pages are printout of my email sent on 13th July, 2018 to Sh. Vineet Joshi, Director General of National Testing Agency (NTA) with related trailing emails and attachments and the last page of the document is the screen image of the webpage of NTA captured at 1.20PM on 28/07/2018. In my email dated 13th July read with trailing emails sent to the Minister of HRD and other MHRD officials I have clearly explained how Diploma and HSC (Vocational) students have been discriminated in admission to NITs, IIITs and other CFTIs (excluding only IITs) through JEE Main and this discrimination is still continued as it is evident from information published on the website of NTA as recent as 28/07/2018 at 1.20PM. It therefore seems that MHRD and NTA officials are sleeping over the continued discrimination of Diploma and HSC (Vocational) students and no action has been taken by them. \nNow, in the above background, as an active citizen, I seek following information from concerned CPIO(s) of the public authority, Department of Higher Education under MHRD through speed post:\n1.Certified copy of all information (note-sheets, correspondences including electronic records etc.) related to educational qualification fixed for admission into NITs, IIITs and other CFTIs (excluding only IITs) through JEE Main 2013 to JEE Main 2018.\n2.Certified copy of all instructions/advisory/letters or other records of MHRD through which Diploma and HSC(Vocational) qualifications were excluded from the list of educational qualifications for admission into NITs, IIITs, other CFTIs (only excluding IITs) through JEE Main 2014 to JEE Main 2018 by CBSE.\n3. Certified copy of all instruction/advisory/letters or other records of MHRD through which NTA has been informed/advised to exclude Diploma and HSC(Vocational) qualifications from the list of educational qualifications published by NTA on its website for admission into NITs, IIITs, other CFTIs through JEE Main 2019. \n4. Certified copy of all notesheets and correspondences made in/by NTA as well as MHRD in respect of my email dated 13th July 2018.\nPlease note that the objective of the Right to Information Act, 2005 is to enable citizens to secure access to information under the control of public authorities, in order to promote transparency and accountability in the working of every public authority. It is stated in the Right to Information Act, 2005 that democracy requires an informed citizenry and transparency of information which are vital to its functioning and also to contain corruption and to hold Governments and their instrumentalities accountable to the governed.\nPlease also note that as per Section 22, the Right to Information Act, 2005 overrides all existing Acts including the Official Secrets Act. Further, the information sought by me are not included among 11 subjects listed in Section 8 of the Right to Information Act, 2005 and hence cannot be refused to me |

CPIO has provided a false reply. All the four information sought must be available with the Ministry of Human Resource Development as NTA has been set up only a few weeks earlier. Only part of information sought vide point no. 3 and 4 may be available with NTA. Part of information sought sought vide point nos. 1 to 4 may be available with CBSE by CPIO has not transferred part of RTI request to CPIO of CBSE. \nBeing officer in rank senior to CPIO under the same public authority you can provide all the four information directly to me instead of directing CPIO to provide which will save time. \nAs quasi judicial authority you are supposed to do no only justice but should also be seen to be doing justice to me. \nI do not want any personal hearing and request you to allow my appeal, take action against CPIO for providing a false reply. I will file a separate complaint agaibst CPIO for false reply under section 18 (1) of the RTI Act read with Section 20 ibid to CIC in a few days. |
