First Appeal with condonation of delay due to covid-19
(1) Q-1, 2 Learned CPIO have not cited total amount to be deposited nor generated payment link on the rtionline portal for the actual objective criteria submitted of awarded CBSE secondary teachers of 2015. FAA is requested to direct learned CPIO to please generate link on the rtionline portal in view of covid-19 ( to avoid IPO use).
(2) Q-3 till date , no such list is available as declared by learned CPO nor any url /pdf given by learned CPIO .
(3) Q-4 No relevant reply by learned CPIO about removal of list showing 404 error (due to removal from the website).
(4) RBI vs Kishanlal Mittal in W.P.(C) 1388/2012 of Delhi highcourt para-9 mandates detailed reasons of FAA in deciding first appeal - When the order passed by the First Appellate Authority is challenged before the Commission, it is required to deal, at least briefly with the reasons given by the First Appellate Authority in support of its decision. Similarly, in the event of the order being challenged before a Writ Court the said Court would not be in a position to know what were the reasons which impelled the Commission to set aside the order passed by the First Appellate Authority. The order of the Commission must necessarily disclose at least brief reasons for disagreeing the view taken by the First Appellate Authority, and setting aside the order.
(5) Kindly deliver pointwise speaking order of STILL PENDING Q-1 to 4 with opportunity to me to submit my view in real time during telephonic hearing in COVID-19 as per principles of natural justice as mandated in the RTI act, DoPT Guide for FAA-OM No.l/3/2008-IR dated 25th April, 2008 esp. para-38,41
(6) Kindly consider three supreme court judgments for disposal necessitating detailed reasons pointwise by conducting quasi-judicial hearings by executives attached. One more important judgment of supreme court of Namit Sharma v/s Union of India in Writ Petition (CIVIL) NO. 210 of 2012 wherein it was held as follows-In keeping with the principles of natural justice it is binding upon a First Appellate Authority to a grant of hearing to a RTI Appellant.
(7) Kindly specifically cite (HITHERTO IGNORED IN ALL PREVIOUS APPEALS) grounds 5,6 of this appeal in the decision emphasizing Quasi-judicial procedure for first appeal decision laid down by supreme court as well as DoPT guide for FAA (2008)
(8) In section 19(5), In any appeal proceedings, the onus to prove that a denial of a request was justified shall be on the Central Public Information Officer or State Public Information Officer, as the case may be, who denied the request. (1) Q-1, 3 to 5 Learned CPIO have not given my desired information of prevailing practice of wide public interest in view of merely 20 percent weightage for objective criteria . Such information needs disclosure under section 8(2) in wide public interest. FAA should provide this information.
(2) Q-2 no notesheets were attached as cited in the reply.
(3) Q- 3 to 5 learned CPIO have declared revised criteria since 2018 whereas my query is long prevailing practice having objective criteria evaluation to be mere 20 percent.
