Appeal:
Dear sir,\nPlease provide me the information under RTI Act, 2005.\nI have requested some information from CPIO, The Ministry of Human Resource Development on 21/09/2016. but didnot received any information. \nAs per Section 7(1) of the RTI Act 2005, the CPIO was to give the requested information within 30 days of the application, that is before 21/10/2016.\nSince, NO REPLY has been received from the CPIO to my RTI Application as per Section 7(1), this First Appeal is made under Section 19(1) of the RTI Act 2005.\nA copy of the said application is attached herewith. \n\nMY PRAYER/PLEA IN THIS FIRST APPEAL:\n\n1. Instruct the PIO, in writing, to give complete information as requested in my above mentioned RTI Application.\n\n2. Issue a written warning to the PIO, under the present Rules and Regulations of Service, instructing him that he should adhere to the time limits specified in the RTI Act 2005 as well as respect the RTI Act in its letter and spirit.\n\n3. Inform the concerned CPIO that the appellant will move a Second Appeal before the SIC/CIC under Section 19(3) and will demand imposition of Penalty under Section 20 of the RTI Act, at the rate of Rs. 250.00 for every day of delay (subject to a maximum of Rs. 25,000.00) from the date the information was due (21/10/16) till the date the information is actually given to me.\n\n4. As per Sec 19(5) of the RTI Act 2005, during the appeal proceedings, the CPIO, should be asked to explain his deemed denial of request for information, since the onus to prove that the denial of request was justified, is on the PIO.\n\n5. As per Sec 7(6) of the RTI Act, the CPIO should now provide me the information free of charge since the provision of information has been delayed beyond the mandated 30 days as provided in Sec 7(1) of the RTI Act.\nThanking You,\n\n\n\n\n
