The 1st appeal pertains to following 1. Refusal of information of copy of the application submitted against the advertisement for recruitment of Directors in IITs submitted by Dr.B.K.Mishra as denied under section 8(1)(J) of the RTI Act 2005. 2. Falsified copy of vigilance clearance certificate dated 28.12.2017 as communicated by CPIO. Grounds of appeal That the appointment of Directors in IITs are recruited under Public interest and being the citizen of India, it induces every right for a citizen to know about the openness, transparency of the documents, recruitment process and accountability of administration in carrying out such recruitment. That the supplied copy of the vigilance clearance certificate dated 28.12.2017, the futuristic date which has not yet come clearly indicates that the application filed by the candidate Dr.B.K.Mishra is incomplete and suppressing the copy of such application construed as suppression of fact showing malafideness when the vigilance certificate is required to be submitted along with the application on or before 31.05.2016. Hence, for larger interest of public, the information may kindly be disclosed and supplied to the applicant under this act in order to bring transparency in Public recruitment under larger public interest. It is out of scope but felt relevant to mention that Dr.B.K.Mishra has been served with notice by the Honble High Court Orissa vide W.P. C 19399/2016 filed under Public interest litigation about his illegal continuance of Director at CSIR-IMMT, Bhubaneswar although arbitrarily absorbed in the post of Scientist-H in actual.
