There are two reasons for the appeal: 1. Refused access 2. Some of the forwarded authorities have not responded 1. The information sought under point 1 of my application has been refused saying that it is in violation of section 8 of the RTI Act 2005. I would like to bring to your notice that the above claim is baseless, as the information requested pertains to a public office, and not an individual.It is nothing but a performance measure of the office of the director of all new IITs, and disclosure of the same will not account to an invasion of personal privacy as such a report only deals with professional performance. Also there is no threat to the life of the individual and disclosure is also not hampering any ongoing process of investigation or prosecution. Additionally, nothing contained in the report has been confidentially received, I believe, from a foreign government, and disclosure of this information shall not harm national interest or security and integrity of India. I am unable to find a court order that prohibits the disclosure of this information, and this does not violate the privilege of the legislature. More so, the matter has to deal with a public office and does not contain articles of commercial confidentiality or anything that would affect a fiduciary relationship. Given the nature of this information, as a performance statistic, it would only being the greater public interest to put these information in public domain, so that the stakeholders are well aware of the performance of their institutional leaders. Hence I humbly request you to instruct the concerned that the above information does not fall under the premise of Section 8, RTI Act 2005. 2. Non receipt of responses from forwarded PIOs Ms. Prisca Mathew replied to this request in a letter dated 2nd December 2014, which was uploaded on the portal on 3rd December 2014. The letter was received earlier and had also been marked to the PIOs of all the newer IITs. Please note, the portal only shows 1 page of the letter, while there are 2 in actuality. Of these, only the PIOs of IIT Bhubaneshwar, IIT Ropar, IIT Mandi, IIT Gandhinagar and IIT Hyderabad have responded till 10th January 2015, in which they mention that they have recieved these requests between 5th and 8th December 2014. Hence, since the window of 30 days is past, I request you to look into the matter at the earliest, and ensure that the same is replied to. Since I filed my initial request with the DHE, the portal allows me to file my appeal with DHE itself, and hence this appeal regarding forwarded authorities has also been filed with you. Regards,
