2966 DOHED/R/2015/61908/1 nil RTI ALSO FORWARDED TO CPIO PG AND DO/O SEand L FOR CBSE MATTER POINT NO 5 AND 6 PERTAINS TO TS-I SECTION A grievance was lodged by me at the public grievance portal ( i.e www.pgportal.gov.in), with registration number DSEHE/E/2015/01176, on 7th April 2015 and also four written application , regarding the same was sent by me (nearly two months before) to the following people: 1.Rajbir Singh, Executive Director(JAB), CBSE 2.Shashi Prakash Goyal, JS(TEL), MHRD 3.Dr. Satbir Bedi, CBSE Chairperson 4.Satyanarayan Mohanty, Secretary (two months before) , Department of Higher Education, MHRD In this context, I, Abhishek Patnaik, a citizen of india , request you to kindly provide me the following information under RTI Act, 2005: 1, Please tell me the daily progress made on grievance application as well as on the grievance lodged at the public grievance portal ( i.e www.pgportal.gov.in) so far i.e when did my application reach which officer, for how long did it stay with that officer and what did he/she do during that period. 2.Please tell me name and designations of officials who were supposed to take action on my grievance application and who have not done so far. 3.Please tell me name and designations of officials who were supposed to take action on my grievance lodged at the public grievance portal ( i.e www.pgportal.gov.in) and who have not done so far. 4.What action would be taken against these officials for not doing their work and causing harassment to public and by when would that action be taken. 5.JEE Main( offline and online) as well as JEE Advanced examinations are over now.Now what procedure should be followed by me, so that I can take admission into good IIT, this year, with good branch . 6. Of Higher Education, Technical section-I) dated 26th November 2013, issued by Mr Alok Mishra (Director IIITs) to Director of IIITDand M Kancheepuram with Subject :- Career Advancement scheme (CAS) clarification-reg. The above said letter was put before the honble HIGH COURT OF JUDICATURE AT MADRAS, in the case W.A.Nos.2187 and 2188 of 2013. In the said case the honble court said:- respondent in his clarification letter dated 26.11.2013 has clearly stated that there is no provision for automatic movement or up-gradation to higher grade merely on completion of certain years of service and it has to be done only on the recommendation of a duly constituted selection committee The above said letter was presented before the honble high court as further explanation to para 3(ii) of MHRD directive (No.3-2712009-TS.11 Government of India, Ministry of Human Resource, Development ,Department of Higher Education, Technical Section-I1, New Delhi, 3oth December, 2009). The directive dated 30.12.2009 was issued as a part of pay commission recommendations for CFTIs. Please provide the following information:- 1.Please provide the name of members of the committee who decided to issue the above said letter dated 26.11.2013. Also please provide a certified copy of minutes of said meeting. 2.In case, no committee was constituted for amendment of above mentioned directive dated 30.12.2009. Then, please quote the rule under which Mr Alok Mishra (holding post of director at MHRD) on his own issued the above said letter dated 26.11.2013, which amounted to amendment of a document issued as part of pay commission recommendation. Precise information is not provided, the reply is vague. The reply can be interpreted by me as :- 1.That, no Committee was constituted for the amendment of MHRD directive dated 30.12.2009. And, Mr Alok Mishra issued the letter dated 26th November 2013 on his own. 2.That, Mr Alok Mishra transgressed his power in issuance of letter dated 26th November 2013. 3.That, without any rule/assigned power, Mr Alok Mishra issued the letter dated 26th November 2013. And, thereby on his own amended MHRD directive dated 30.12.2009. I request you to please provide me the required information or confirm my above conclusion as the reply is completely vague.
